Oregon’s Building Performance Standard applies to commercial buildings ≥ 20,000 sq ft across the state. If you own or manage any of the following, you have a compliance deadline.

What is the Oregon Building Performance Standard?
Oregon’s BPS (HB 3409, 2023) requires large commercial buildings to meet energy efficiency targets and report compliance to the Oregon Department of Energy (ODOE). Buildings that don’t comply face significant financial penalties.
How do I know if my building qualifies? ⌄
Tier 1 covers hotels, motels, and commercial buildings ≥ 35,000 sq ft — these must meet energy performance targets. Tier 2 covers commercial buildings 20,000–34,999 sq ft, plus schools, multifamily, and hospitals ≥ 35,000 sq ft — these must benchmark and report. Not sure? We’ll check for you in a free assessment.
What happens if I don't comply?
Penalties are $5,000 plus $1 per square foot. A 75,000 sq ft building faces an $80,000 fine. Non-compliant buildings may also lose access to grant funding that can offset upgrade costs.
How long does the compliance process take?
18 months or more, start to finish. The earliest Tier 1 deadline is June 1, 2028 — which means the largest buildings need to start now.
Is financial assistance available?
Yes. BERI, ECAP, and Energy Trust incentives can be stacked to offset most or all costs. All are first-come, first-served. We help you apply for and combine all three.
